Student speech is back in the news with two recent decisions out of the Third Circuit.
While both cases involved fake MySpace profiles of teachers created by students while off campus, the cases were decided differently. These cases further highlight the point we spent a bit of time on in class last week -- we need to have decipherable law in this area. Lack of clear notice on these issues threatens to chill off campus, student speech in a very serious way.
